Court rules in favor of Trasacco against Woodfields over 48-acre land

The Appeals Court has ruled that Trasacco Company Limited is the legitimate owner of some 48 acres of land at Borteyman in the Tema district of the Greater Accra Region.

A High Court had earlier ruled in favour of Trasacco as true owners of the parcel of land which was disputed by Woodfields Development Company Limited.

Woodfields had encroached on portions of the land, pushing Trasacco to take the matter to court.

It is not yet clear if Woodfields Development Company Limited will want to take the matter to the Supreme Court.

Background

A civil suit was commenced at the Accra High Court, Land Court ‘2’, in July 2013 between Trasacco Estates Development Company Limited as the Plaintiff and Woodfields Development Company Limited as the 1st Defendant – with Comet Roofing and Property Development Limited as 2nd Defendant, concerning some lands belonging to the Plaintiff at Borteyman in the Tema district of the Greater Accra Region.

The High court upon examination ruled in favour of Trasacco as true owners of the parcel of land in dispute. The matter was then appealed to the Court of Appeal by Woodfields.

The Court of Appeal after careful examination and in consideration of the facts and evidence available to the court unanimously ruled in favour of Trasacco, affirming the High Court’s decision; as in the wisdom of the Court, Woodfields had encroached upon a land that belonged to Trasacco Company Limited.
